Please carefully review the following rules and restrictions governing your use of our mobile application, "digitalScore," our website at https://digitalScore.app, and all associated products, services, and features (collectively, the "Services"). digitalScore is one of our offerings, and your use of our other products, services, websites, applications, and materials is subject to their respective terms. These Terms of Use (the "Terms") constitute a binding contract between you and Symphonic Hub, SL ("digitalScore," "we," or "us"). By using the Services in any manner, you agree to these Terms, which will remain in effect while you use the Services. These Terms include the provisions in this document, as well as those in the Privacy Policy, Copyright Dispute Policy, and any other relevant policies.

 

Scope of the Terms

These Terms apply when you download the digitalScore App on your personal device and use the Services under a license granted directly by us (referred to as the "Individual Mode"). Certain entities or organizations (e.g., businesses, universities, school districts, or educational institutions, collectively "Organizations") may purchase licenses for the digitalScore App through Apple’s volume purchase programs. In such cases, the Organization may enroll devices under its volume licenses in Apple’s mobile device management ("MDM") system. The features of the digitalScore App under the MDM Mode may differ from those under the Individual Mode. For example, the MDM Mode may restrict to use the backup feature while using the multiple users feature. Unless explicitly stated otherwise, references to the "digitalScore App" and "Services" in these Terms pertain to the Individual Mode.

Your use of or participation in certain Services may also be subject to additional policies, rules, or conditions ("Additional Terms"), which are incorporated herein by reference. By using or participating in such Services, you agree to comply with these Additional Terms.

   

Key provisions

These Terms contain important information about the Services provided to you, including charges, taxes, and fees. They also cover future changes to the Terms, limitations of liability, a class action waiver, and dispute resolution through arbitration instead of court.

ARBITRATION NOTICE AND CLASS ACTION WAIVER: Except for certain types of disputes described in the Arbitration Agreement section below, you agree that disputes between you and us will be resolved through binding, individual arbitration, and you waive your right to participate in a class action lawsuit or class-wide arbitration.

   

Will These Terms Change?

We may update these Terms as we improve our Services. We reserve the right to modify the Terms at any time. If we do, we will notify you by posting a notice on our website at https://www.symphonichub.com, sending an email, or using other means.

If you do not agree to the updated Terms, you may reject them; however, this will result in your inability to continue using the Services. Your continued use of the Services after any changes to the Terms constitutes your acceptance of the updated Terms.

No other amendments or modifications to these Terms will be effective unless made in writing and signed by both you and us.

Basic Use of digitalScore

You agree to use the Services only for personal, non-commercial purposes, in compliance with all applicable laws. If your use of the Services violates any laws, you are not authorized to use them. We are not responsible for your use of the Services in violation of the law.

   

Restrictions on Use

You agree not to:

• Infringe or violate intellectual property rights or other rights of any party, including digitalScore.
• Violate any law or regulation, including export control, privacy, or other applicable laws.
• VEngage in dangerous, harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or objectionable behavior.
• Violate the security of any computer network or crack passwords or encryption codes.
• Use automated means to "crawl," "scrape," or "spider" any part of the Services or Content.
• Copy or store any significant portion of the Content.
• Decompile, reverse engineer, or attempt to obtain the source code or underlying ideas of the Services.

Violations of these restrictions may result in termination of your access to the Services.

   

Rights in the Services

The Content displayed or available through the Services (e.g., text, graphics, data, photos, images, illustrations) is protected by copyright and intellectual property laws. You agree to abide by all copyright notices, trademark rules, and restrictions contained in any Content you access.

We grant you a worldwide, non-exclusive, non-sublicensable, and non-transferable license to use Content solely for the purpose of using the Services. Any other use, reproduction, modification, distribution, or storage of Content is prohibited without prior written permission from us.

   

Third-Party Services and Disputes

The Services may contain links to third-party websites or services not owned or controlled by digitalScore. We are not responsible for the content, accuracy, privacy policies, or practices of third-party sites. Your interactions with third parties are solely between you and them.

In the event of disputes between users or with third parties, digitalScore is under no obligation to intervene. You release digitalScore from any claims, demands, or damages arising from such disputes.

   

Changes to the Services

We may modify, suspend, or discontinue any part of the Services at any time. We will attempt to notify you of material changes that adversely affect you, but this may not always be practical.

   

Fees and Payments

Some Services may be free, while others may require payment. If you use a free version, we will notify you before any fees apply. For Paid Services, payment terms are incorporated into these Terms. Payments are processed through Apple’s App Store, and refunds are handled by the App Store.

You agree to provide accurate billing information and authorize us to charge your payment method for all applicable fees.

   

Mobile Applications and In-App Purchases

The availability of our mobile application depends on third-party app stores (e.g., Apple App Store). You agree to comply with the terms and conditions of such stores. In-App Purchases are subject to Apple’s terms and conditions, and digitalScore is not a party to such transactions.

   

Warranty Disclaimer and Limitation of Liability

The Services and Content are provided "as-is," without warranties of any kind. To the fullest extent permitted by law, digitalScore and its affiliates are not liable for any indirect, special, incidental, punitive, or consequential damages arising from your use of the Services.
